TERMS OF SERVICE

1. Introduction
1.1 MCNV is the exclusive owner and holder of a software (the “Software”), which also includes the integration of an algorithm based on artificial intelligence mechanisms, designed to assist ophthalmologists, orthoptists and, in general, healthcare professionals working in the field of ophthalmology and optics, in hospitals and health facilities (“Healthcare Professionals”). The Software aims to detect any signs indicating the presence of active and inactive neovascular myopic macular degeneration within the retinal area analysed by means of optical coherence tomography (OCT).
1.2 MCNV is the exclusive owner of an online website (the “Website”), accessible at the address www.mcnv.ai, through which the Software can be used by Healthcare Professionals.


 2. Description and Limitation of the Software
2.1 The Software is designed to provide information for indicative purposes and is not intended to replace clinical judgement, medical diagnosis or professional treatment. The results obtained should only be considered as additional decision support.
2.2 Any clinical decision based on the results obtained from the Software is the sole responsibility of the Healthcare Professional. He must integrate his decision with his own clinical judgement and, if necessary, with other ocular diagnostic and clinical examinations, the patient’s medical history and the general clinical context.
2.3 The algorithm used by the Software is based on predictive models and does not guarantee the accuracy, completeness or reliability of the results. Any errors, inaccuracies or misinterpretations cannot be attributed to MCNV.

3. Conditions for use of the Software
3.1 In order to obtain a diagnosis, the Healthcare Professional must upload, through the dedicated section on the website, the spectral-domain optical coherence tomography (SD-OCT) images of the macular retinal lesion to be analysed.
3.2 The Healthcare Professional must not upload images other than tomographs or use the Software for purposes other than those set out in these Terms of Service.

4. Images anonymisation
4.1 The Healthcare Professional must only upload anonymous images on the Website, i.e. images that do not contain any personal data of the patient such as the first name, the second name and the date of birth. Similarly, the date and time the image was taken or other personal information such as address or email address may not be uploaded.
4.2 It is forbidden to upload images on the website that have not been previously anonymised, and the Healthcare Professional therefore assumes all responsibility in this regard.

5. Exclusion of Liability
5.1 MCNV declines any liability for:
-inaccurate or incomplete diagnosis;
– actions or omissions made by the Healthcare Professional in relation to the information obtained through the Software;
– any direct, indirect or consequential damages resulting from the use of the Software.

6. Data Protection and Privacy
6.1 MCNV and the Software do not collect or process any personal data of the patients to whom the tomographic images refer as they are already anonymised at the time of uploading. MCNV is a ‘cookieless’ website and therefore no information is collected about the IP address from which the Healthcare Professional connects, for any reason or purpose.
6.2 The images uploaded through the Software are used to provide a diagnostic report to the Healthcare Professional, and, after the report, they are integrated within the algorithm in order to enrich and refine it, and to improve the sensibility and specificity of the Software. By uploading the images, you consent to their use for this purpose, too.

7. Intellectual Property
7.1 The Software, including the algorithm and its content, is protected by copyright and the other applicable laws.
7.2 The Healthcare Professional acknowledges that all the intellectual property rights relating to the Software belong solely to MCNV.
7.3 It is forbidden to copy, modify, distribute or use the Software for unauthorised purposes.

8. Miscellaneous
8.1 MCNV reserves the right to modify or suspend the Software at any time and without notice.
8.2 Modifications to these Terms of Service will be posted on the website. Continued use of the Software implies acceptance of the changes made.
8.3 The Software may not be available in certain geographical areas or during maintenance periods
8.4 It is not guaranteed that the Software is free of technical errors or interruptions.

The diagnostic analysis provided by myopicCNV+™ is intended to provide an aid to the practitioner but not to replace the final clinical judgement, which must always be assessed by a professional ophthalmologist.
